An introduction to Intellectual Property Rights

Intellectual Property Rights (IP) are primarily made up of:

  • Copyright.
  • Trade Marks.
  • Patents.
  • Designs.
  • Trade Secrets and Confidential Information.

They provide a monopoly right for your use and you may wish to licence third parties to commercially use your IP on agreed terms. Anyone using the IP rights without permission, or outside the terms of the licence, would be potentially infringing such rights, which would certainly allow you, the owner, to take legal action, seek an injunction and claim damages or an account of profits.

IP is a vast area touching on software, literature, music, images, inventions, pharmaceuticals, clothing designs, bespoke furniture – the list is endless. In fact, all around you is IP of some sort.
