What is Intellectual Property?

Intellectual Property is a wide umbrella definition which covers a range of intangible property rights and ownerships allowing the owner to commercialise those rights in order to generate revenue or to protect the rights.

A broad range of Intellectual Property can be protected. The main types to consider are Trademarks, Patents, Copyright and Designs as well as Trade Secrets.

What is a Trademark?

A Trademark may include your business name, your business logo or even a slogan, a product getup that is unique to your business.

A Trademark can be very personal to the businesses and its style and nature. You can even protect a smell or colour – useful if you are in the perfumery trade.

How do I Trademark my Business Name?

First of all, it is very important to engage with a specialist who can undertake a full search report of your intended Name or Logo. This is crucial as you do not want to run the risk of applying for a Trademark that is similar in Class or description to any other. This could expose you to an IP dispute/opposition.

There are many Classes for a Trademark – 45 in total.  The first 35 cover goods and the last 10 cover services. It is important that you apply for a Trademark in the correct Class or Classes, as there may be more than one that sparks your interest. It is therefore essential to receive correct, clear advice in advance.

Once you have successfully registered your Trade Mark, you will be given a certificate of registration confirming the date which your TM was registered and this lasts 10 years. As a result, this enables you to place an “R” in a circle next to your brand/logo/mark.

Additionally, you can take legal action against anyone who uses your TM without permission and ayou can also sell or licence your TM.

Can I Copyright my Businesses website and the content?

The answer is yes! If the content and web design is original and created by you then it retains copyright protection so that anyone copying it would be infringing your rights.

Copyright is also available for all types of work that are original and unique to its Author, also including books, drawings, photographs, paintings, recipes, sound recordings and much more.
