What is Court of Protection?
The Court of Protection assists people who can’t make decisions at the time they need to be made (they ‘lack capacity’). These decisions can relate to a person’s property and finances or their health and welfare. The Court will usually appoint a suitable person (known as a ‘Deputy’) to make decisions in line with the Court of Protection’s rules and guidance.
What is a Capacity Assessment?
A capacity assessment is an informal assessment – usually in the form of an extended conversation – undertaken by a suitably qualified independent professional. The assessment assists the Court in understanding what decisions a person can make, what decisions they can’t make, and what decisions they need to be supported with.
What are the outcomes of a Capacity Assessment?
There can be many outcomes for a capacity assessment, however, the key conclusion will be whether a Deputy is required. Alternatively, if there are other routes to support the person can be considered.
Do I need to make an appointment for you to meet the person who may lack capacity?
Yes, usually. It is important for one of our Solicitors to meet with the person to better understand what their level of capacity may be, and whether a Court of Protection application is the most appropriate route.
How do I gain access to the finances of my loved one who is incapacitated?
If the person has not previously created a Lasting Power of Attorney and it is confirmed that they lack capacity, then the only option open to you is a Court of Protection application to have someone suitable appointed as Deputy.
What authority do I need to be able to make Health and Welfare decisions on behalf of my love one who is incapacitated?
The Court of Protection also deals with Health and Welfare matters. The Court can choose to appoint someone specific as a Health and Welfare deputy, or can make decisions on a one-off basis.
Accordingly, both involve an application to the Court in order to gain the correct authority.
