What is full and frank disclosure?

In any divorce, it is vital there is complete financial transparency for both parties before negotiations can begin. This is called entering into full and frank financial disclosure. During this process, you and your spouse are required to provide evidence of all income and assets held both in the UK and out of our jurisdiction. It is common for many of these assets to then require valuing by the appropriate experts, such as surveyors, forensic accountants and pension actuaries, to ensure exact valuations are known for all assets held by you and your spouse.

Our accounts team will provide you with a detailed invoice each month Mary’s fees are £300 plus vat per hour and she is assisted by Chloe Santoni, and also a Sean Aldridge a Specialist in Trust and Estate Planning who is charged at £250 per hour plus vat. Mary and Chloe are assisted by very experienced Legal Secretary, Alexandra Tavoni.
Mary will discuss with you whether you are required to pay spousal maintenance and if so at what rate and for how long or whether a clean break can be achieved in relation to both capital, income, property and pensions.
If you and your spouse have agreed all of your financial matters by consent then the costs are considerably reduced and once you have exchanged financial information, a draft consent order is prepared and approved and signed by both parties and their solicitors and it is then submitted to the Court for the Judge to approve accompanied by a D81 Form and the court fee.
The new No Fault Divorce Procedure takes 20 weeks from the date you issue your petition on the court portal to the granting of a Conditional Order (replacing the old style Decree Nisi). Thereafter you can apply for a Final Order no less than 6 weeks after and the Court can then make a Final Order (replacing the old style Decree Absolute).
