High Net Worth Divorce

Mary Lowe at Vincents Solicitors is our High Net Worth Divorce specialist team based in Lytham.

Do I have to share my pension?

One of the most frequently asked questions Mary is asked by her Divorce clients is whether they have to share their pension or if they will benefit from their spouse’s pension once they are divorced.

As part of the Divorce process, each party will need to declare all of their assets and income. If you have a pension, it must be included as part of what is known as full and frank disclosure.

Mary has vast experience and knowledge regarding pensions and has built up an excellent working relationship with the most experienced Pension Actuaries in the North West of England. These experts provide reports for both Mary and the Court to advise as to the amount of pension share you are to give or receive, ensuring fair division of all assets, including pensions. They also help to equalise income upon your retirement and determine whether a pension share is deemed fair and reasonable considering all the circumstances of your case.

Frequently asked questions

Mary is also very alive to the fact you will be worried about how much your divorce and financial matter will cost you and she will discuss costs with you at every interview and will provide costs estimates throughout your case. Our accounts team will provide you with a detailed invoice each month Mary’s fees are £300 plus vat per hour and she is assisted by Chloe Santoni, and also a Sean Aldridge a Specialist in Trust and Estate Planning who is charged at £250 per hour plus vat. Mary and Chloe are assisted by very experienced Legal Secretary, Alexandra Tavoni.
Mary will discuss with you whether you are required to pay spousal maintenance and if so at what rate and for how long or whether a clean break can be achieved in relation to both capital, income, property and pensions.
If you and your spouse have agreed all of your financial matters by consent then the costs are considerably reduced and once you have exchanged financial information, a draft consent order is prepared and approved and signed by both parties and their solicitors and it is then submitted to the Court for the Judge to approve accompanied by a D81 Form and the court fee.
The new No Fault Divorce Procedure takes 20 weeks from the date you issue your petition on the court portal to the granting of a Conditional Order (replacing the old style Decree Nisi). Thereafter you can apply for a Final Order no less than 6 weeks after and the Court can then make a Final Order (replacing the old style Decree Absolute).

Good morning,

I just wanted to send an appreciation email! People are often quick to complain but not as quick to give appraisal.

This is the second time that I have used Vincent’s solicitors and I have yet again been very happy with the service received. Any queries I had were always answered efficiently & I never felt that I asked too many questions (or that they were silly to ask!). Nothing was too much trouble. Joe, also a great point of contact with again great communication and always very helpful.

Thank you so much for making this a stress free process, and I will continue to recommend Vincent’s Solicitors & the team there.

Happy Monday & have a great week!

Kind regards,
Jessica

Following completion on my property sale I just wanted to show my appreciation for Vincents conveyancing services and in particular the support provided by Kerry Rankine.

Kerry was efficient, responsive and proactive throughout the transaction, her efforts made what could have been a stressful process straightforward and stress free, please pass on my personal thanks.

Now that this property has been sold we need to sort out our Wills & LPAs and I would appreciate an introduction to a suitable contact within Vincents, our preference would be to visit the Garstang office.

Regards
Adrian

I’m writing to thank you and your entire law firm for all of your hard work throughout my case.

Throughout the time we worked together, everyone at your law firm was kind, patient, and supportive. My hectic university schedule  made it difficult for me to respond quickly, so your team was sure to email me every time there was a new development.

I cannot thank you enough for the amazing treatment you gave me. I hope that our paths should never have to cross again (no more broken bones for me!), but if they do, I’m confident your hard work and determination will make my case a breeze.

I turned to Vincent’s with a challenging situation that needed very careful handling. Michael and Drew were respectful, understanding and supportive. This made them easy to liaise with and I always felt they had my back. Good at listening to what I wanted, we worked together in finding the best way to draw the matter to a close. This eased my stress and worry. I now highly recommend their services to anyone who needs legal advice and help. Thank you both.
