SIPPs and SSASs (Commercial Properties purchased via pension funds)

A commercial property can be purchased through individual and company pension schemes. There are two types of schemes known as Self-Invested Personal Pension (SIPP) and Small Self-Administered Scheme (SSAS), which provide users a tax beneficial investment.

It is important that you appoint a solicitor who is experienced in dealing with the additional complexities of purchasing or selling a commercial property through a SIPP or SSAS. In property related transactions we require two forms of ID. Individuals must provide a photographic form of ID and up to date proof of address. If a company or other organisation is instructing us, we will require a photographic form of ID and up to date proof of address for the Directors/Members of the company and also any persons who have significant control of that company. We will verify the ID provided to us via a secure third-party platform. Examples of suitable ID include: a passport, drivers’ licence, bank statement, utility bill or council tax bill.

Whilst we endeavour to deal with your matter as quickly as possible, timescales for commercial property matters are dependent on several factors and it is not always possible to provide a timescale from the outset of your matter. Timescales are determined by the following: satisfying our on-boarding process; the complexity of the legal work involved; the number of parties involved and their co-operation in dealing with the matter swiftly. Our commercial teams consist of 3-4 people per team, so there will always be someone on hand to deal with your matter and answer any queries you may have.
We provide a fee estimate at the outset of your matter. The fee estimate takes into account the type of commercial property matter, value of the transaction, legal work involved and an estimate of time that will be spent on your matter. We will always be transparent regarding our costs and any third-party disbursements that will be payable.
Once you have instructed us, we will open a new file and issue our client care documentation for you to sign. Your client care pack details many important points relating to your matter, which include the scope of our instructions and estimated legal costs, our service and terms of business, data protection form and anti-money laundering forms. You will also be requested to provide ID and source of funds documentation, if applicable.
