What is a Pre-Nuptial Agreement?

A Pre-Nuptial Agreement is a contract entered into and signed by both parties and their experienced legal representatives, with a schedule attached detailing each party’s assets and liabilities owned and accrued pre-marriage. This contract sets out the terms upon which the wealthier party will share their wealth, both capital property and income, with their spouse depending on the duration of the marriage. These documents do not override Section 25 of the Matrimonial Causes Act 1973 but are considered by the court as one factor when dividing the assets of a couple divorcing at a later stage after the marriage has taken place.

If you have considerable pre-marital wealth, it is worth seeking advice before marriage on how to best protect it through a Pre-Nuptial agreement.

What is a Post-Nuptial Agreement?

Often there are hiccups in a marriage where a couple may separate for a time and then decide to reconcile. When this happens, one or both parties may want financial security or clarity, and this is when a Post-Nuptial Agreement is useful. It is a contract that sets out the terms of financial security one party is willing to offer to the other at that particular stage of the marriage and often for each future successful year of marriage. This can help mend a broken marriage by avoiding one party feeling more financially vulnerable than the other.

Our accounts team will provide you with a detailed invoice each month Mary’s fees are £300 plus vat per hour and she is assisted by Chloe Santoni, and also a Sean Aldridge a Specialist in Trust and Estate Planning who is charged at £250 per hour plus vat. Mary and Chloe are assisted by very experienced Legal Secretary, Alexandra Tavoni.
Mary will discuss with you whether you are required to pay spousal maintenance and if so at what rate and for how long or whether a clean break can be achieved in relation to both capital, income, property and pensions.
If you and your spouse have agreed all of your financial matters by consent then the costs are considerably reduced and once you have exchanged financial information, a draft consent order is prepared and approved and signed by both parties and their solicitors and it is then submitted to the Court for the Judge to approve accompanied by a D81 Form and the court fee.
The new No Fault Divorce Procedure takes 20 weeks from the date you issue your petition on the court portal to the granting of a Conditional Order (replacing the old style Decree Nisi). Thereafter you can apply for a Final Order no less than 6 weeks after and the Court can then make a Final Order (replacing the old style Decree Absolute).
